User Guide: Responding to a Letter of Intent to Terminate (LOIT)

This guide is for those who received a Letter of Intent to Terminate (LOIT).

  1. When you log in to your MySBA Certifications account, on your dashboard click the Messages button where you will be able to see all messages that have come in. You can also access this by clicking the Notifications tab and clicking on the Messages notification, normally it is going to be the first notification.

  1. By clicking on the notification from the Notifications tab, you will be taken directly to the message. This is where you will see the entire context of the Letter of Intent to Terminate (LOIT) letter.

  1. At the top of the message you will see instructions on how to prevent your business from termination. You will need to fix/address the issues mentioned in the letter within 30 days of the receival of the letter. Failure to do so will result in being terminated.

The message is as follows: SBA has determined you may no longer be eligible for 8(a). See the attached Notice of Intent to Terminate for reasons why you may no longer be eligible. You have 30 days to respond and correct the identified issue(s) in order to remain in compliance. You may discuss this issue with SBA via the Messaging Center in MySBA where you can find and respond to a copy of this Notice. If you do not respond and resolve these issue(s) in that time, SBA will terminate you for 8(a).

Note: All official letters are going to be located in your Document Center.

  1. In the body of letter there will be additional information that will let you know the reason for this decision, consequences of not responding, and how/where to respond.

  1. Scroll to the bottom of the letter to find the reply option. To upload supporting documents, click the Upload button and select your document you wish to upload. The chosen document appears below the message. When ready, click the arrow icon at the bottom to send your reply.
